The terms of service are listed below. It is important that you read these terms and conditions carefully because by using our product, website and applications (the product), you will be deemed to have accepted them.

1. Acceptance of terms

By using Orange Cross, you agree to the following terms and conditions ("T&C"), which may be updated by us from time to time without notice to you.

2. General Provisions

The purpose of Orange Cross is to provide a means of communication relating to Health and Safety information

The information and tools that make up our product are not intended to be a substitute for professional advice nor do they address specific circumstances of any particular situation; individual or entity.

3. Communication

You acknowledge and agree that Orange Cross may occasionally send you communications regarding your account or the service via email.

4.Accounts, Passwords, and Security

As a registered user you are responsible for keeping your password secure. You will be solely responsible and liable for any activity that occurs under your user name.

5.Intellectual Property

We reserve all our rights in our copyright including, but not limited to, text, design, graphics and images and intellectual property both in digital and analogue form. You acknowledge and accept that we are either the owner or otherwise have the right to use content and you will not assert any claim or interest in or to our intellectual property – including copyright.

You may print any part of this website for your own use within your business but are prohibited from using it for commercial gain. Any other use including copying, distributing or republishing without our prior written permission is strictly prohibited.

You may not use any trademarks, logos or branding without our prior written permission.

6.Limitation of Liability


The Content (including the materials and information) provided by Orange Cross is supplied upon the strict condition that you will make your own determination as to the suitability of the Content that you use.

In no event shall Orange Cross Ltd or any agent, representative or employee of Orange Cross Ltd be liable for any indirect, special, incidental, consequential or punitive damages (including but not limited to loss of use, loss of profits, or loss of data) whether in an action in contract, tort (including but not limited to negligence), equity, or under any other legal principle arising from the use of or inability to use the Content and/or this service or the materials therein or resulting from unauthorized access to or alteration of data.

We exclude all implied representations and warranties in respect of the use of the content and/or service to the fullest extent permitted by law.

Users of Orange Cross Ltd should refer to legislation relating to No Contracting Out (Section 28, H&S Work Act, 2015) in relation to their Person Conducting a Business or Undertaking (PCBU) responsibilities.

7.Your Privacy

You can access Orange Cross portal without having to disclose personal information. However, if you use the service to communicate personal information you will not remain anonymous to those you are sharing information with.

Orange Cross is committed to ensuring the privacy or your information under the Privacy Act 1993. However, you are to be aware that the internet is not always a secure environment

Orange Cross reserves its right to use "cookies" and/or collect Internet Protocol (IP) addresses (or similar technology) to identify, improve and provide personalised feature and for tracking traffic pattern to and from our Website and all other reasonable uses.

8.Defined Terms

Unless the context otherwise requires, in these terms and conditions, the following terms have the following meanings:
  • "Content" means all information, materials, text, graphical and other visual content, as well as all audio content contained in our website/portal;
  • "Trademarks" means all of our trademarks, whether registered or unregistered;
  • "you" means you; and
  • "we", "us" and "our" means Orange Cross Limited, as well as our officers, employees and agents

9. Acceptable Use And Conduct

The software and service are made available to you, your company, and/or your customers only for personal or commercial use, which use must be in compliance with all applicable laws, rules and regulations and must not infringe or violate third party rights. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, use of the service, or access to the service without the express written permission by Orange Cross.

10.Returns And Refunds

Accounts are, generally, billed monthly. Any monthly plan can be cancelled at any time and the next bill will be cancelled. There will be no returns or refunds for previous months. There will be no exceptions in order to keep it fair across all customers.

Those signing for promotions that have a fixed term agree to meet the minimum requirements of that term or forfeit any discount. Such termination will also incur an administration fee equal to two months of full subscription ($100 +GST).

Any unauthorized use of Orange Cross is a violation of this agreement and certain New Zealand legislative laws. Such violations may subject the unauthorized user and his or her agents to civil and criminal penalties.
